Terms of Service

These terms apply when you download or play Elementia, a game made by Tempest Wolf Studios (“we”, “us”), the trade name of Alexandre Lafarque, a sole proprietorship registered in Belgium under enterprise number 1042.557.087, Franz Guillaumelaan 33 bus 9, 1140 Evere. By playing, you agree to them. If you don’t agree, please don’t play the game. Nothing in these terms takes away rights you have under the consumer law of the country you live in.

Playing the game

We give you a personal, non-exclusive, non-transferable licence to play Elementia on your own devices, for your own entertainment. The game, its creatures, cards, artwork, names, music, code and everything else in it belong to Tempest Wolf Studios or its licensors. You may not copy, sell, rent, redistribute or make commercial use of the game or its content, or try to extract its source code or assets, except where the law allows it.

Your progress

Elementia has no accounts. Your progress is saved only on your device. It is lost if you uninstall the game or clear its data, unless you have first used Export in Settings to copy a save code. We have no copy of your save and cannot restore it for you.

Gems, packs and other items

The game has virtual items such as Gold, Gems, packs, cards, essence and potions. They exist only inside the game: they have no value in real money, cannot be exchanged for money or anything outside the game, and cannot be sold or transferred, except as the game itself allows. You get a licence to use them in the game; you do not own them.

Packs contain cards chosen at random. The chance of each rarity is shown in the game (the i on each pack) before you open one. Some offers, such as packs sold for real money, are not available in every country; what the store in your country allows is what the game shows.

We may adjust items, prices, drop rates and game balance in updates. We won’t take away items you have paid for, except where they are removed along with a feature, in which case we will do our best to offer a fair replacement.

Purchases

In-app purchases are made through the App Store (Apple) or Google Play (Google), and their terms, payment rules and refund policies apply. Refund requests go to them. Items that stay with you, such as Remove Ads and Unlimited Stamina, can be restored on a new device in Settings > Purchases > Restore. Items that are used up, such as Gems and packs, cannot be restored once they have been delivered to your save.

Ads

The game can show optional rewarded videos, which you choose to watch for an in-game reward. They are provided by Google AdMob. How information is handled for ads is explained in our Privacy Policy.

Fair play

Please don’t cheat. You may not use hacks, modified versions of the game, bots or tools that change how it works, and you may not exploit bugs to gain an advantage. If you find a bug, we’d be grateful if you told us.

Changes to the game

We keep working on Elementia. Updates may add, change or remove features and content. We may also stop offering the game one day; if we do, we will say so in advance where we reasonably can.

Our responsibility

We work hard to make the game good and reliable, but we can’t promise it will always be free of bugs or interruptions. To the extent the law allows, the game is provided “as is”, and we are not responsible for losses that we could not reasonably have foreseen, or that arise from things outside our control. Nothing here limits our responsibility where the law does not allow it to be limited, or affects your statutory rights as a consumer.

Applicable law

These terms are governed by Belgian law. If you live elsewhere in the European Union as a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you can bring a claim in the courts there as well as in Belgium.

Changes to these terms

If these terms change, the new version will be published on this page with a new date. If a change is important, we will also let you know in the game.
